TERMS OF USE AND CONDITIONS OF PURCHASE

Welcome to Premium Nutrition for Pets trading as DASH Dog Food and its affiliated companies and brands and our Terms of Use and Conditions of Purchase (these "Terms").
PLEASE CAREFULLY READ THESE TERMS BEFORE USING THE SERVICES OR PLACING AN ORDER.
Note that Section 15 of these Terms contains a mandatory arbitration provision that requires DASH Dog Food and you to use binding arbitration on an individual basis and limits the remedies available to DASH Dog Food and you in the event of certain disputes. By agreeing to these Terms, DASH Dog Food and you are giving up our rights to bring our disputes before a jury or as a member of class action.
By accessing or using the services provided by Premium Nutrition for Pets, Inc, trading as DASH Dog Food or our subsidiaries or other affiliates, or affiliated brands (collectively, "DASH Dog Food," "we," "us" or "our") through our websites, blogs and/or mobile applications (collectively, the "Sites" and together with such services, the "Services") you agree to be bound by these Terms and all of the Terms incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Services.
The dashdogfood.com website and the DASH Dog Food trademark are wholly owned by Premium Nutrition for Pets Inc.
If you are using the Services on behalf of any entity, you represent and warrant that you are authorized to accept these Terms on such entity’s behalf and that such entity agrees to be responsible to us if you or such entity violates these Terms.
DASH Dog Food reserves the right to change or modify these Terms at any time and in our sole discretion. If we make material changes to these Terms, we will provide notice of such changes, such as by sending you an email notification or providing notice through the Sites. By continuing to access or use the Services in any way after such notice has been provided, you confirm your acceptance of the revised Terms and all of the terms incorporated therein by reference. We encourage you to review the Terms frequently to ensure that you understand the terms and conditions that apply when you access or use the Services or Order. If you do not agree to the revised Terms, you are free to reject them and will not be able to access or use the Services.
1. Privacy Policy
Please refer to our DASH Dog Food Privacy Policy, available at www.dashdogfood.com/privacy-policy/ for information about how we collect, use, and disclose information about you.
2. Eligibility
The Services are not targeted toward or intended for use by anyone under the age of 18. By using the Services, you represent and warrant that you (a) are 18 years of age or older, (b) are a legal resident of the United States, (c) have not been previously suspended or removed from the Services, or engaged in any activity that could result in suspension or removal from the Services, and (d) have full power and authority to enter into these Terms and in so doing will not violate any other agreement to which you are a party.
3. Registration and Communication Preferences
By supplying DASH Dog Food with your email address during the checkout process at this Site, you also consent to receive electronic communications from us (e.g., via email or by posting notices to the Sites). These communications may include notices about your purchase and are part of your relationship with us. You agree that any notices, agreements, disclosures, or other communications that we send to you electronically will satisfy any legal communication requirements. You may opt out of receiving promotional emails at any time by following the unsubscribe instructions provided therein.
4. Terms of Sale
A. Products, Payment, and Billing Information
1. PRODUCTS. We make certain meat or other products made available for purchase through the Services (collectively, the "Product(s)").
2. PAYMENT AND BILLING INFORMATION. By providing a credit card or other payment method that we accept, you represent and warrant that you are authorized to use the designated payment method and that you authorize us (or our third party payment processor(s)) to charge your payment method for all charges you incur for the purchase of any Products (including any applicable taxes and other charges). In the event you want to change or update payment information associated with your Order, you will need to email support@dashdogfood.com.
B. Substitutions
All of our Products are subject to availability, and we reserve the right to impose quantity limits on any Order, to reject all or part of an Order, to discontinue offering certain Products, and to substitute Products without prior notice. We strive to provide you with high-quality Products, and given certain market conditions beyond our control, we may be required to make substitutions from time to time. If you are not satisfied with a substitution, please contact us at support@dashdogfood.com.
C. Cancellation Policy
YOU MAY CANCEL AN ORDER AT ANY TIME PRIOR TO SHIPMENT OF SUCH ORDER BY EMAILING support@dashdogfood.com. YOU ARE RESPONSIBLE FOR ALL CHARGES (INCLUDING ANY APPLICABLE TAXES AND OTHER CHARGES) INCURRED WITH RESPECT TO ANY ORDER PROCESSED PRIOR TO THE CANCELLATION OF YOUR ORDER.
D. Pricing and Availability
All prices shown via the Services are in U.S. dollars. Any applicable taxes and other charges, if any, are additional. We reserve the right to change our Product offerings and to adjust prices as we may determine in our sole discretion, at any time and without notice.
E. Shipping and Handling
You agree to pay any shipping and handling charges shown at the time you place an Order. We reserve the right to increase, decrease, add, or eliminate shipping and handling charges from time to time, but we will provide notice of the charges applicable to you before you complete your Order. Generally, shipping is handled by a third party courier. Actual delivery dates may vary from your Order checkout. You agree that you will not obtain, or direct shipment of, a Product for export. All Products purchased from us are made pursuant to a shipment contract.
F. Deliveries
You are responsible for inspecting all Products you receive from us for any damage or other issues upon delivery. In addition, you are solely responsible for determining the freshness of the Products you receive. In the unlikely event that you have any reason to believe that any Product in your delivery is not suitable for your pet's consumption, contact us at support@dashdogfood.com (attaching photos of the item(s)) and discard the item(s). From the time of delivery, the condition and your pet's consumption of the Products are solely at your risk, and you are solely responsible for the proper and safe handling, preparation, storage, and use of the Products following delivery.
All of our Products are individually packaged and labeled, placed inside boxes that feature built-in insulation specially designed to keep Products within the optimal temperature range, with dry ice if necessary. Your Order will typically remain cold and fresh for several hours, but depending on the season and temperature in your geographic area at the time of delivery, advance planning by you should be made for proper storage of your Products prior to consumption.
G. No Resale
You are not permitted to resell or otherwise use the Products for commercial purposes.
H. Returns and Refunds
We are unable to accept returns on food items due to safety regulations.
If you are not completely satisfied with your DASH Dog Food Products, please contact support@dashdogfood.com. We will happily review your Order and any reported issues and offer a replacement of the Product in question, credit towards your next Order, or a partial/full refund.
I. Cancelled Orders
You are liable for any Orders placed or charges that are incurred prior to the cancellation request. If the request for cancellation is made after your Order has been processed and/or shipped, the request will not be processed, and your Order will not be cancelled.
J. Damaged Products
Courier Damaged Products: In the event of damage caused by improper handling or late delivery, we are happy to file a claim and replace the shipment. Please email support@dashdogfood.com within seven (7) days of receipt, provide a description of the damage, and a photo(s) of the Order in the state it was received.
Damaged Products (not courier related): Please email support@dashdogfood.com within seven (7) days of receipt, provide a description of the damage, and a photo(s) of the Order in the state it was received. We will offer an appropriate resolution, which may include replacement of the Product in question or a partial/full refund.
K. No Human Consumption; No Incorrect Species Consumption
The DASH Dog Food Products have not been evaluated, tested, or approved for human consumption. All DASH Dog Food Products are intended for animal consumption only and only for the specific animal for whom the DASH Dog Food Products are labeled. You hereby waive all claims against us for your negligence in consuming DASH Dog Food Products or providing DASH Dog Food Products to another human for consumption or an animal that is not intended to eat such Product.
5. License to Access and Use Our Sites and Content
Unless otherwise indicated in writing by us, the Services and all content and other materials contained therein, including, without limitation, the DASH Dog Food logo and all designs, text, graphics, pictures, information, data, software, sound files, other files, and the selection and arrangement thereof (collectively, "Content") are the proprietary property of DASH Dog Food or our licensors or users, as applicable, and are protected by U.S. and international copyright laws. You are hereby granted a limited, nonexclusive, nontransferable, non-sublicensable license to access and use the Services and Content solely for their intended purposes.
6. Trademarks
All marks, service names, logos, or slogans that may appear on the Services or Products are trademarks of DASH Dog Food and may not be copied, imitated, or used, in whole or in part, without our prior written permission. All other trademarks, registered trademarks, Product names, and company names or logos mentioned on the Services or Products are the property of their respective owners.
7. Hyperlinks
We make no claim or representation regarding, and accept no responsibility for, the quality, content, nature, or reliability of third party websites accessible by hyperlink from the Services. Such sites are not under our control, and we are not responsible for the contents of any linked site. We provide these links to you only as a convenience, and the inclusion of any link does not imply our affiliation, endorsement, or adoption of any site or any information contained therein.
8. Third Party Content
We may display content, advertisements, and promotions from third parties through the Services (collectively, "Third Party Content"). We do not control, endorse, or adopt any Third Party Content, and we make no representations or warranties of any kind regarding such Third Party Content, including accuracy or completeness.
9. User Conduct
You agree that you will not violate any law, contract, intellectual property, or other third party right or commit a tort, and that you are solely responsible for your conduct while accessing or using the Services. You agree that you will abide by these Terms and will not engage in any harassing, threatening, intimidating, predatory, or stalking conduct; use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services; reverse engineer any aspect of the Services; or use the Services for any illegal or unauthorized purpose.
10. Feedback
You are always free to submit questions, comments, suggestions, ideas, or other information about DASH Dog Food, the Services, or the Products (collectively, "Feedback"). Feedback is non-confidential and shall become the sole property of DASH Dog Food. DASH Dog Food shall be free to use such Feedback for any purpose, commercial or otherwise, without acknowledgment or compensation to you.
11. SMS Terms and Conditions
BY SIGNING UP TO PARTICIPATE IN DASH Dog Food'S SMS PROGRAM, YOU AGREE TO BE BOUND BY THESE SMS TERMS AND CONDITIONS AS WELL AS DASH Dog Food'S TERMS OF USE AND CONDITIONS OF PURCHASE, AND PRIVACY POLICY.
By choosing to opt-in to DASH Dog Food's optional SMS Program, you consent to receive autodialed marketing, transactional, and promotional texts from or on behalf of DASH Dog Food at the mobile number you provide. Consent is not a condition of purchase.
Message frequency varies. Message and data rates may apply. To opt out, text STOP. For help, text HELP, or contact support@dashdogfood.com. Carriers are not liable for delayed or undelivered messages.
12. Indemnification
To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless DASH Dog Food, and our respective past, present, and future employees, officers, directors, contractors, consultants, equity holders, suppliers, vendors, service providers, parent companies, subsidiaries, affiliates, agents, representatives, predecessors, successors, and assigns (individually and collectively, the "DASH Dog Food Parties"), from and against all actual or alleged DASH Dog Food Parties or third party claims, damages, awards, judgments, losses, liabilities, obligations, penalties, interest, fees, expenses, and costs of every kind and nature whatsoever arising from (a) your use or misuse of the Services, Content, or Products, (b) any Feedback you provide, (c) your violation of these Terms, or (d) your violation of the rights of another.
13. Disclaimers
YOU ARE SOLELY RESPONSIBLE FOR THE PROPER AND SAFE HANDLING, PREPARATION, STORAGE, AND USE OF THE PRODUCTS YOU RECEIVE FROM US AND THE FEEDING OF THE PRODUCTS TO YOUR PET. YOU ARE ALSO SOLELY RESPONSIBLE FOR KNOWING ABOUT ANY FOOD ALLERGIES YOUR PET MAY HAVE AND FOR VERIFYING THE SUITABILITY OF ALL PRODUCTS BEFORE HANDLING, PREPARING, USING, OR FEEDING THE PRODUCTS TO YOUR PET. OUR SERVICES, THEIR CONTENTS, AND ALL INFORMATION, PRODUCTS, AND SERVICES MADE AVAILABLE THROUGH OUR SERVICES ARE PROVIDED ON AN "AS IS," "AS AVAILABLE" BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, DASH Dog Food, ITS SUBSIDIARIES, AND ITS AFFILIATES DISCLAIM ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DASH Dog Food OR ANY OF THE OTHER DASH Dog Food Parties BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND ARISING OUT OF OR IN ANY WAY RELATED TO THE ACCESS OR USE OF THE SERVICES OR CONTENT OR THE ORDER, RECEIPT, OR USE OF ANY PRODUCT, REGARDLESS OF THE FORM OF ACTION.
15. Dispute Resolution; Arbitration
PLEASE READ THE FOLLOWING SECTION CAREFULLY BECAUSE IT REQUIRES DASH Dog Food AND YOU TO ARBITRATE CERTAIN DISPUTES AND CLAIMS AND LIMITS THE MANNER IN WHICH DASH Dog Food AND YOU CAN SEEK RELIEF UNDER THESE TERMS.
Binding Arbitration: For any dispute arising out of or related to these Terms or the Services, Content, or Products, to the extent permitted by applicable law, you and DASH Dog Food agree to waive your respective rights to have any and all disputes resolved in a court, and to waive your rights to a jury trial. Instead, you and DASH Dog Food agree to arbitrate disputes through binding arbitration.
No Class Arbitrations, Class Actions, or Representative Actions: You and DASH Dog Food agree that any dispute is personal to you and DASH Dog Food and that any dispute will be resolved solely through individual arbitration.
Notice: You and DASH Dog Food agree that each party will notify the other party in writing of any dispute within thirty (30) days of the date it arises. Notice to DASH Dog Food shall be sent by certified mail or courier to PO Box # 610069 Newton Highlands, MA 02461.
Process: Any dispute must be commenced by you or DASH Dog Food within one (1) year of the date the dispute arose. Arbitration will be conducted confidentially by a single arbitrator in accordance with the rules of the Judicial Arbitration and Mediation Services ("JAMS"). The state or federal courts of the Commonwealth of Massachusetts, County of Middlesex, City of Cambridge, have exclusive jurisdiction over any appeals.
Opt-Out Right: You have the right to opt out of binding arbitration within thirty (30) days of the date you first accepted these Terms by writing to: PO Box # 610069 Newton Highlands, MA 02461.
16. Governing Law and Venue
These Terms, your access to and use of the Services, and your Order, receipt, and use of the Products shall be governed by and construed and enforced in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law rules or principles that would cause the application of the laws of any other jurisdiction. Any dispute not subject to arbitration shall be resolved in the state or federal courts of the Commonwealth of Massachusetts, County of Middlesex, City of Cambridge.
17. Termination
Notwithstanding anything contained in these Terms, we reserve the right, without notice and in our sole discretion, to terminate your right to access or use the Services and to order, receive, and use the Products, at any time and for any or no reason.
18. Severability
If any term, clause, or provision of these Terms is deemed invalid or unenforceable, then that term, clause, or provision will be severable from these Terms and will not affect the validity or enforceability of any remaining part of these Terms.
19. Survival
The following sections will survive the expiration or termination of these Terms: all defined terms and Sections 1; 4–16; and 18–20.
20. Miscellaneous
These Terms constitute the entire agreement between you and DASH Dog Food relating to your access to and use of the Services and your Order, receipt, and use of Products. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you without the prior written consent of DASH Dog Food. No waiver of any provision of these Terms will constitute a waiver of such provision in any prior, concurrent, or subsequent circumstance.
21. SMS.
SMS Terms By enrolling in or using our SMS service, you agree to these SMS Terms. We may change or discontinue the service or its features at any time without notice. Continued use after any change to these SMS Terms means you accept them. By opting in, you agree to receive recurring SMS/text messages from or on behalf of DASH Dog Food OpCo, LLC at the number you provided. Messages may be sent using an automatic dialing system or other automated technology and are powered by Recharge, Inc. Messages may include transactional (e.g., order updates, account alerts) and promotional content (e.g., special offers, product launches, cart reminders). Your consent is not required to make a purchase. Participation is voluntary. Message frequency may vary. Standard message and data rates may apply; check with your carrier for details. To opt out, reply “STOP” to any message. For help, contact us at support@dashdogfood.com. DASH Dog Food OpCo, LLC is not responsible for delayed or undelivered messages. Carriers are not liable for message delays or failures. If your mobile number changes, you must re-enroll to continue receiving messages.
